General Sales Conditions

Article 1: Scope

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the online store of the genealogy firm (hereinafter referred to as "the Seller"). They govern the contractual relationship between the Seller and any individual or legal entity wishing to make a purchase through the website (hereinafter referred to as "the Client").

Article 2: Products and Services

The firm offers various genealogy services:

  • The creation of classic family trees, trees focusing on the maternal line (cognatic) or paternal line (agnatic), as well as surname-based trees.

  • The search for civil status records after 1792, including birth, civil marriage, and death records.

  • The search for records prior to 1792, including baptisms, religious marriages, burials, and burial registers.

  • The search for civil marriage publications after 1792 and banns publications before 1792.

  • The search for marriage contracts, inheritance and absence tables, and inheritance declarations.

  • The search for a soldier’s military service record, a sailor’s maritime registration, and census records.

  • Assistance with clients' genealogical research.

  • Verification of family trees or research conducted by the Client.

  • Digitization of the Client’s family tree.

  • Transcription of records in French or Old French.

The descriptions of the products and services available on the website are as precise as possible.

Certain requests may be denied if the root individual of the family tree was born too recently and their civil status records are still subject to confidentiality restrictions (75 years).

Orders for certain records may also be refused if the departmental archives holding the individual’s records do not allow public access due to document inaccessibility, lack of preservation, or destruction (due to environmental causes or war). In such cases, the order will be canceled and the Client refunded. It is therefore recommended that the Client verify in advance that the sought-after document is part of the relevant departmental archives. Most departmental archive websites offer an inventory listing the available documents.

Regarding the creation of classic, agnatic, cognatic, or surname-based family trees, a branch may end prematurely if the child was abandoned by both parents or if the mother or father is listed as "unknown." These situations may block research for the individuals concerned. If such an interruption occurs early in the research, a negotiation with the Client may be considered for a potential partial refund.

Article 3: Pricing and Payment

Prices are listed in euros and include all taxes (TTC). Payment is made online through the secure payment methods offered on the website. The Seller reserves the right to modify its prices at any time, but products will be billed based on the rates in effect at the time of order validation.

Accepted payment methods:

  • Payment by credit card, processed through the STRIPE payment processor.

  • Payment by direct transfer (SEPA) through the STRIPE payment processor.

Article 4: Order and Confirmation

Any order placed on the website constitutes acceptance of these GTC. The Client receives a confirmation email summarizing the order details. The Seller reserves the right to cancel or refuse any order in the event of a dispute with the Client or suspicion of fraud.

Article 5: Right of Withdrawal

In accordance with applicable law, the Client has a 14-day period to exercise their right of withdrawal for physical products, starting from receipt.

However, under Article L221-28 of the French Consumer Code, this right does not apply to services that have already begun with the Client’s agreement, nor to personalized products. By validating their order, the Client expressly agrees that the service begins before the withdrawal period expires and therefore waives their right of withdrawal.

Article 6: Delivery

Delivery times vary depending on the products and services ordered. Deliveries of documents or physical products are made to the address provided by the Client when placing the order. The Seller cannot be held responsible for delays attributable to postal services.

Delivery times range from a few days for simple records to up to one year for the most complex services.

Only one format is available for clients outside of France for delivery :

  • Digital format: Files will be sent in GEDCOM, JPEG/PNG, or PDF format.

Article 7: Liability

The Seller undertakes to provide services in accordance with the descriptions presented on the website. However, it cannot be held liable for errors or omissions in the data provided by the Clients or derived from the archival sources consulted.

Article 8: Personal Data

The information collected is intended for order management and service improvement. The Client has the right to access, rectify, and delete their personal data in accordance with current regulations.

Personal data collected is subject to professional secrecy. Discoveries made during genealogical research will be integrated into a database accessible only to members of the genealogy firm.

Article 9: Disputes and Applicable Law

These GTC are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action.

A consumer mediator specializing in genealogy is available: Gérard Gaucher, reachable at contact@mediateurconso-genealogistesfrance.fr.

If no amicable agreement is reached, any dispute regarding the interpretation or execution of these GSC will be submitted to the Commercial Court of Versailles, which has jurisdiction over the Yvelines region.

Article 10: Contact

For any questions regarding these GTC, the Client can contact the Seller via the contact details provided on the website.
